THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27126 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the notice in Lr.No.188/UC/CIR21/TPS/GHMC/2019, dated 28.11.2019, issued by the 3rd respondent, as arbitrary and illegal.

Heard the learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondent Nos. 2 and 3.

Learned counsel for the petitioner would submit that the petitioner has to submit explanation to the impugned notice, dated 28.11.2019, but, in the meantime, the respondents are trying to demolish the structures made by the petitioner in respect of premises bearing No.1-36/1/12 in Survey No.212/A1, situated at Vemana Colony, Chandanagar, Serilingampally Mandal, Ranga Reddy District.

Learned Standing Counsel appearing for respondent Nos.2 and 3 would submit that if the petitioner gives any explanation to the impugned notice, dated 28.11.2019, the same will be considered in accordance with law.

Having regard to the same, without expressing any opinion on merits of the case, the Writ Petition is disposed of granting liberty to the petitioner to file an explanation to the impugned notice, dated 28.11.2019, issued by the 3rd respondent, within a period of ten (10) days from today. On filing of such explanation,

the authorities concerned shall consider the same and take action as per law. Till then, no coercive steps shall be taken against the petitioner in respect of subject construction of premises bearing No.1-36/1/12 in Survey No.212/A1, situated at Vemana Colony, Chandanagar, Serilingampally Mandal, Ranga Reddy District. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ A.RAJASHEKER REDDY, J 6th December, 2019 Note:
