HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7191 of 2018 ORDER:

The petitioner is the sole accused in crime No.45 of 2018 of Gurramkonda Police Station, Chittoor District, registered for the offences punishable under Sections 354-A, 354-D, 506 & 509 IPC and Section 12 of Protection of Children from Sexual Offences Act.

Heard learned counsel for petitioner and the learned Public Prosecutor representing the State in opposing the same and perused the FIR, contents of the bail application and other material on record.

A perusal of the record no way entitles the petitioner to the concession of anticipatory bail. However, it is made clear that as none of the offences are punishable above seven years, the Police in the event of arrest strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1.

Accordingly and in the result, this Criminal Petition is disposed of.
