This Civil Revision Petition arises out of order, dated 23.6.2016, in I.A.No.32 of 2016 in O.S.No.443 of 2004 on the file of the learned IV Additional Senior Civil Judge (Fast Track Court), Visakhapatnam.

A perusal of the order of the lower Court would show that though it has held that there are laches on the part of respondent No.1 in contesting the suit, it has, however, taken a lenient view and gave a final opportunity to the said respondent to let in evidence.

Mr. K.Chidambaram, learned counsel for the petitioner, lamented, and justifiably so, that respondent No.1 has been trying to drag on the suit and that the lenience shown by the lower Court is causing severe hardship to his client. However, considering the fact that the lower Court has exercised its discretion in favour of respondent No.1, I am not inclined to interfere with such discretion. The lower Court is, however, directed to dispose of the suit as expeditiously as possible, and not later than four months from the date of receipt of a copy of this order.

Subject to the above direction, the Civil Revision Petition is dismissed.
