Notice having been ordered, the respondents entered appearance through learned counsel and filed their counters.

Upon hearing arguments and perusing the record, this Court finds that no allegation of willful disobedience has been levelled by the petitioner against the respondents. Unless such a specific allegation is made out, the provisions of the Contempt of Courts Act, 1971 would not be attracted keeping in mind the definition of 'civil contempt' under Section 2(b) thereof. Apart from this technical aspect, this Court finds that the only action on the basis of which the contempt case was filed is that respondent No.1 being the President of Andhra Pradesh Olympic Association ratified the action taken report on the resolution of the meeting held on 24.03.2013 whereby respondents 3, 4 and 5 in Writ Petition No.9162 of 2013 were recognized as office bearers. It is no doubt true that this Court passed an order on 26.03.

2013 restraining respondents 1, 2 and 7 in the said writ petition from dealing with respondents 3 to 5 in the capacity of office bearers. However, mere action on the part of the Andhra Pradesh Olympic Association in approving the action taken report of the meeting held on 24.03.2013 does not constitute willful disobedience as it is possible that said ratification was effected by oversight. That being the situation, the benefit of doubt would necessarily have to be given to the respondents.
