This Writ Petition is filed for a Mandamus to declare the action of the respondents, in not considering the petitioner for appointment as permanent fair price shop dealer in place of his deceased father, as illegal and arbitrary. The father of the petitioner, who was the permanent dealer of Fair Price Shop No.23 of Lashkar Singaram, Hanamkonda Mandal, died on 24-10-2006 and following his death, a nonlocal candidate was appointed as the fair price shop dealer. Subsequently, his authorization was cancelled. On coming to know about the vacancy, the petitioner has made a representation on 17-11-2012 to consider him for appointment in place of his father.

At the hearing, the learned Government Pleader for Civil Supplies (TS) submitted that so far, the vacancy has not been filled up on permanent basis. He has further stated that the erstwhile State of Andhra Pradesh has issued G.O.Ms.No.4 dated 28-02-2014, providing for compassionate appointment to one of the eligible family members of the deceased dealers subject to certain conditions and that the petitioner's case will be considered under the said GO, provided, he satisfies the criteria prescribed therein.

In the light of the above facts and the submissions of the learned Government Pleader, the Writ Petition is disposed of, without expressing any opinion on the entitlement or otherwise of the petitioner for appointment as permanent fair price shop dealer under compassionate appointment scheme and with the direction to respondent No.3 to consider the petitioner's claim in terms of G.O.Ms.No.4, dated 28-02-2014, and communicate his decision to the petitioner within two

months from the date of receipt of this order. As a sequel to disposal of the Writ Petition, interim order, dated 23-11-2012, is vacated and WPMP.No.46127 of 2012, filed by the petitioner for interim relief, is disposed of as infructuous.
