ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) Respondent Nos.6 and 7 in O.A.No.8063 of 1997 filed this writ petition feeling aggrieved by the order dated 25.09.2003 of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, "the Tribunal").

Though the office endorsement shows that respondent Nos.6 and 7 have been served, the office note placed by it shows that acknowledgments are misplaced and not traceable. Mr. Kasa Jaganmohan Reddy, learned counsel for the petitioners submitted that the Tribunal has allowed the O.A filed by respondent Nos.6 and 7 by erroneously applying the amended rule retrospectively and directed the official respondents to review the promotions by taking into account the methodology in B.Ed as the qualification for teaching the subjects of Maths and Science. He has further submitted that his clients who were promoted as B.Ed Assistants have acquired the B.Ed qualifications after the Tribunal has passed the impugned order. He has also submitted that his clients who were promoted as B.Ed Assistants as of now and that in view of the above facts, there is no threat of their being reverted as Secondary Grade Teachers.

In the light of the above submissions of the learned counsel for the petitioners, the writ petition is closed as its adjudication on merits is not necessary. However, liberty is given to the petitioners to file a fresh writ petition in the unlikely event of their reversion. No order as to costs.
