HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.24441 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer and his authorization was valid upto 31.03.2017. On a surprise check o f the shop of the petitioner, the Assistant Civil Supply Officer, Ranga Reddy District noticed some variation in stock, and initiated 6A proceedings and also seized the stock. The present Writ Petition is filed seeking release of stock so long as the authorisation of the petitioner is in force.

It is needless to mention that, so long as the authorization of the petitioner is in force, he is entitled for supply of stock. However, learned Government Pleader for Civil Supplies has not produced any evidence to show that the petitioner's authorization was suspended, and any action was taken against her. In the circumstances, the Writ Petition is disposed of directing the respondents to release the stock to the petitioner for distribution to the cardholders so long as his authorization is in force.
