O R D E R
This criminal petition is filed under Section 482 of Cr.P.C. to quash the proceedings in DVC.No.32 of 2016 on the file of Prohibition and Excise Court, Kurnool, Kurnool District, registered against the petitioners, who are respondents 1 to 3 before the trial court.
Heard the counsel for the petitioners and the learned Additional Public Prosecutor, representing the State.
Specific allegations were made against the petitioners in the complaint. The truth or otherwise of the allegations can only be decided during the course of trial. I see no grounds to quash the proceedings at this stage.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to proceed with the trial and dispose of D.V.C.No.32 of 2016 within a period of three months from the date of receipt of a copy of this order, without insisting the presence of the petitioners 2 and 3 herein on each and every date of hearing, except required for any specific purpose. However, petitioner No.1 shall appear before the trial court. Pending miscellaneous applications, if any, shall stand closed. No costs.
