HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.23852 of 2018 ORDER:

This writ petition is filed aggrieved by the inaction of respondent No.3 on the complaint dated 25-06-2018 made by the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of the petitioner dated 19-06-2018, a case in Cr.No.86 of 2018 was registered and the petitioner has given one more complaint on 25-06-2018. But the said complaint is not registered. In the written instructions, it is denied that they have received complaint on 25-06-2018. But the learned counsel for the petitioner says that the complaint has not been received by the concerned Station House Officer (SHO). If the complaint is not received by the concerned SHO, the petitioner has remedy under Section 156(3) of Cr.P.C. and the petitioner has to pursue the same.

In view of the above facts and circumstances, it is open for the petitioner to give fresh complaint to respondent No.3 and respondent No.3 is directed to receive the same and take action by following the guidelines laid down in Apex Court judgment of Lalitha Kumari v. Government of Uttar Pradesh1.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
