HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No. 7323 of 2005 ORDER:

This writ petition is filed questioning the action of the respondent in refusing to make an entry in respect of the firm, M/s. Sri Suvin Foods, bearing registration No.2401/2003, in the Register of Firms, about the receipt of notice dated 19.03.2005 dissolving the said firm, as illegal and arbitrary. It is the case of the petitioner that he was inducted as a nominal partner of M/s. Sree Suvin Foods on 02.08.2004 and the duration of the said firm is at will. Subsequent to his induction, as the earlier partners have committed several irregularities, he has given notice dated 19.03.2005 to the other partners dissolving the firm from 21.03.2005, since the partnership is at will. Further, as required under Section 43 of the Indian Partnership Act, 1932, he approached the respondent on 20.03.

2005 with an intention to giving notice of date of dissolution of the firm. But, no order has been passed till today. Questioning the same, the present writ petition is filed. During hearing, the learned counsel for the petitioner requested this Court to direct the respondent to consider the request of the petitioner and pass appropriate orders. In view of the submission made by the learned counsel for the petitioner, the respondent is directed to consider the request of the petitioner and pass appropriate orders, in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
