THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.120 of 2010 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri G. Arun, learned counsel for the appellant, would fairly state that, while the cause in the writ appeal does not survive, the questions of law, which arise for consideration therein, necessitate examination.
We see no reason to examine academic issues. As it is fairly conceded that the cause in the writ appeal does not survive, suffice it, while dismissing the writ appeal as infructuous, to leave the questions of law raised in the appeal open to be agitated, if need be, in appropriate legal proceedings.
The writ appeal fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
