HONOURABLE SRI JUSTICE GUDISEVA SHYAM PRASAD. WRIT PETITION No. 18 OF 2016 O R D E R :
This writ petition is filed to declare the inaction of the second and third respondents in not completing the investigation and filing the charge sheet in relation to F.I.R.No. 34/2015, dated 09/02/2015 lodged with the Central Crime Station, Hyderabad, as illegal, arbitrary and violative of Article 14 of the Constitution of India. The petitioner has also sought for a consequential direction to the second and third respondent to take steps in accordance with on F.I.R.No. 34 of 2015, dated 09/02/2015.
2. Heard the counsel for the petitioner and the learned Public Prosecutor for the respondents 1 to 3 and Sri Kishore Rai, counsel for the un-official respondents.
3. Ms. Mansi Chouwdary, representing Sri M.V.Pratap Kumar, learned counsel for the petitioner submits that she needs time to take instructions from the petitioner. The learned counsel for the un-official respondents submits that after filing of final report on 24/05/2016 under section 173 Cr.P.C., a protest petition was filed on 06/12/2016 and the learned Magistrate has passed orders and registered the case as C.C.No.217 of 2017.
4. Learned Public Prosecutor has informed that he has already filed counter in this matter. At the time of filing the
counter, investigation was not completed and subsequently the investigation was completed.
5. Considering the representation of the learned counsel for the respondents 4 to 6, no further orders are required in this matter, for the reason that the entire investigation has been completed and charge sheet is numbered, hence, this writ petition is dismissed as infructuous. No costs.
6. As a sequel, miscellaneous petitions if any, pending in this writ petition stands disposed of. No costs.
