HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.C.C.A.No.67 OF 2008 JUDGMENT:

Originally, the present appeal was filed on 05.10.1999, but, of course, it was registered in the year 2008.

2. When the matter was called on 31.01.2018, since, there was no representation for the appellant, the Registry was directed to list the appeal under the caption 'for dismissal'.

3. Today also, there is no representation for the appellant. It appears that the appellant is not inclined to prosecute the present appeal, as the present appeal is filed questioning the rate of interest alone.

4. In fact, against respondent No.1, the present appeal stood dismissed for default on 25.07.2007. No steps were pursued by the appellant to get the said dismissal order set aside.

5. Therefore, the present appeal is dismissed for nonprosecution. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J February 01, 2018.
