The petitioner complains against inaction of respondents in considering and disposing of representations, dated 26-11-2009 and 04-05-2010, as illegal, arbitrary and amounts to refusing to exercise jurisdiction conferred on the respondents. The 3rd respondent filed counter affidavit and I have perused the reply of 3rd respondent.

The prayer is one of inaction in disposing of representations said to have been filed by the petitioner.

This court ought not to consider the merits in the assertion of petitioner's representations or reasons stated by respondents for not granting relief prayed in the representations. This has to be primarily done by 3rd respondent. If the petitioner is finally aggrieved by such decision and communication, the petitioner will have option of availing remedies against the said decision within the four corners of law.

Hence, I am satisfied the writ petition can be disposed of by this order.

The petitioner is given liberty to submit copies of the representations, referred to above, by enclosing a copy of this order to 3rd respondent, within four weeks from the date of receipt of a copy of this order, and the 3rd respondent is directed to pass appropriate orders within a further time of two months thereafter.

Accordingly, the writ petition is disposed of. No order as to costs.
