Heard M/s. Indus Law Firm, learned counsel appearing for the
petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.
2. The petitioner is fair price shop dealer of Dondlavagu village, Lingala Mandal of Kadapa district.
She is said to be the permanent dealer and her authorisation is valid up to 31-3-2016. While so, by proceedings dated 23-02-2015, the authorisation of the fair price shop of the petitioner was suspended by the 3rd respondent pending enquiry on the ground that in the inspection, certain variations in the stocks of essential commodities have been noticed. It is submitted by the learned counsel appearing for the petitioner that the panchanama, which is said to be drawn at the time of inspection, does not indicate the particulars of supply of stocks and sale and therefore, the impugned order is unsustainable.
3. Since the impugned order is passed pending enquiry, this Court is not inclined to examine the validity of the suspension order. Under these circumstances, the 3rd respondent-RDO, Jammalamadugu, is directed to conduct enquiry into the allegations levelled against the petitioner and pass final orders within two months from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
