THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1208 OF 2016 ORDER:

The criminal revision case is filed by the petitioner challenging the Referred Charge Sheet No.9 of 2016, dated 11.04.2015 (crime No.83 of 2015 of Chinnamandam Police Station, YSR Kadapa District) on the file of the I Additional Judicial Magistrate of First Class, Rayachoty, Kadapa District, treating the case as false as the complainant called absent and no representation. Heard and perused the records.

The petitioner/complainant filed the complaint against the respondents 2 to 6 herein and that the police filed charge sheet referring the case as false. Notice is served on the petitioner herein, but he could not able to file the protest petition within the time limit since he was suffering from ailments. The learned Magistrate recorded that due to the absence of the complainant, the report filed by the police is accepted and closed the case as false.

Considering the facts and circumstances of the case, the petitioner is directed to file the protest petition before the Court below on or before 20.07.2016 and on such application being filed, the Court below is directed to consider the grounds raised by the petitioner and pass appropriate orders in accordance with law. The criminal revision case is accordingly disposed of.
