THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.10805 of 2010 ORDER:

This writ petition is filed seeking the following relief/s: 'to issue a Writ, Order or direction, more particularly one in the nature of writ of Mandamus, directing the respondents or any Authority, claiming through them in any manner, from Ac.90.44 cents of land in Sy.No.251, 252, 245, 246, 600 and 601 of Madala Village, Muppalla Mandal, Guntur District, belonging to Sri Amareswara Swamyvari Devasthanam, Amaravathi Village and Mandal, Guntur District, in any manner, before the petitioners rights and entitlement under Sec.82 of the Act are decided by the Authority, by following due process of law and pass such other order or orders.' [Reproduced verbatim] I have heard the submissions of the learned counsel for the writ petitioners and the learned Standing Counsel appearing for the fourth respondent.

The learned counsel for the petitioners points out that in the counter affidavit filed by the 1st respondent, it is stated that the 4th respondent temple had again conducted public auction on 03.05.2010 and that the petitioners also participated in the public auction along with others by accepting the auction conditions and that the petitioners 2 to 6 herein and the son of the 1st petitioner viz., Induri Satyanarayana Reddy became highest bidders for the period of three years from 2010-11 to 201213 on cash maktha for six bits of land and paid their highest bid amounts and entered into the land as new lessees and, therefore, the said averment in the counter may be recorded and the writ petition may be disposed of. The learned Standing Counsel submits that the writ petition has become infructuous.

Recording the aforesaid submissions, the writ petition is disposed of as no cause survives for adjudication.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
