HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL REVISION CASE No.1881 OF 2007 O R D E R:

This Criminal Revision Case is filed under Section 397 and 401 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioner to set aside the judgement dated 05.12.2006 made in Crl.A.No.34 of 2006 by the Special Judge for Trial of Offences Under SCs and STs (POA) Act cum VI Additional Metropolitan Sessions Judge, Secunderabad (for short 'Sessions Judge') confirming the judgement and conviction passed in C.C.No.560 of 2002 dated 30.12.2005 by the learned XI Additional Chief Metropolitan Magistrate, Secunderabad(for short 'Magistrate Court') in so far not enhancing the fine and granting the compenstation to the petitioner and allow the revision by granting compensation to the petitioner.

2. After conducting trial the learned magistrate convicted the accused who is respondent No.1 herein by imposing fine of Rs.15,000/- and sentence of one year offence under Section 138 of Negotiable Instruments Act.

Out of such amount Rs.10,000/- was directed to be paid towards expenses of the petitioner/complainant. On appeal the learned Sessions Judge confirmed the conviction in CC.No.560 of 2022.

3. None appears for the petitioner.

4. There is no infirmity in the order of the learned Sessions Judge in confirming the conviction and as seen from the record no petition was filed seeking enhancement of compensation and fine. No error is committed by the learned Sessions Judge in confirming the conviction.

5. For the said reasons the criminal revision case is liable to be dismissed and accordingly dismissed. Miscellaneous applications pending, if any, shall stand closed.
