O R D E R
The grievance of the petitioners in this case was that the Station House Officer, Hayathnagar Police Station, Ranga Reddy District, was interfering with their civil rights in relation to their land admeasuring Ac.03.24 guntas in Sy.Nos.7, 8, 12 and 13 of Kuntlur Village, Hayathnagar Mandal, Ranga Reddy District.
Relying on the written instructions dated 13.04.2012 furnished by the Sub-Inspector of Police, Hayathnagar Police Station, Cyberabad Commissionerate, the learned Assistant Government Pleader for Home informed this Court that the fourth respondent herein lodged a complaint against the first petitioner and others to the effect that they had criminally trespassed into her lands at Kuntlur Village and thereupon, Crime No.191 of 2012 had been registered under Sections 427, 447 and 506 IPC on the file of the Hayathnagar Police Station. He further stated that an appropriate charge-sheet was laid before the learned VII Metropolitan Magistrate at Hayathnagar, Cyberabad, and that the first petitioner herein was shown as accused No.1 therein.
In the light of the aforestated facts, it is clear that the petitioners' allegation that the police were interfering with their civil rights without just cause is shown to be without basis. As the first petitioner herein was arrayed as an accused in a criminal case, the police necessarily had to investigate the matter and in that process, summon and examine him. As the charge-sheet is stated to have already been laid before the competent criminal Court, the issue raised does not survive for adjudication in this writ petition.
The writ petition is accordingly dismissed.
