THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.3748 of 2015 ORDER :

The present Criminal Petition is filed by the petitioner under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.122 of 2014 of D.Hirehal Police Station, Ananthapuram District, registered for an offence punishable Section 379 IPC. The case of the prosecution is that Additional Assistant Engineer, Operation, APSPDCL, Bommanahal, dated 27.11.2014 lodged a report stating that on 26.11.2014 Udehal 16 KVA Agriculture DTR Top cove opened and copper wire stolen by unknown culprits at night distribution transformer located at Nagalapuram fields. Basing on the said report, the above case came to be registered.

Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State. Learned Public Prosecutor on instructions submits that the petitioner is involved in two more cases and that he is one of the receivers of the stolen property.

A perusal of the remand report of other accused would show that the petitioner is one of the receivers of the stolen property. Hence, I am not inclined to grant anticipatory bail to the petitioner. However, the petitioner if so advised shall surrender before the concerned Court and move an application for grant of bail before an appropriate Court after giving notice to the Public Prosecutor, in which event the same shall be dealt with on merits in accordance with law either on the same day. _________________________ JUSTICE C.
