HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.4817 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.

This Writ Petition is filed seeking to declare the action of 3rd respondent in suspending the authorization of the petitioner in respect of fair price shop No.6, Kumili Village, Pusapatirega Mandal, Vizianagaram District, as arbitrary and illegal.

The petitioner is the dealer of fair price shop No.6, Kumili Village, Pusapatirega Mandal, Vizianagaram District. On the allegation that the petitioner is distributing the essential commodities by less weighment to some of the card holders and he is not maintaining the timings, the 4th respondent directed the Mandal Inspector to conduct enquiry and submit report. Based on the report of the Mandal Inspector, the 3rd respondent suspended the authorization of the petitioner. Learned counsel appearing for the petitioner submits that the suspension order was passed based on mere general allegations and without affording any opportunity to the petitioner. He further submits that so far no enquiry has been initiated for passing the final order.

Having regard to the facts and circumstances of the case, the impugned order dated 30.08.2014 is suspended. However, this order does not preclude the respondentauthorities to initiate enquiry and pass final order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
