THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.26543 of 2013 Order:
This Writ Petition is filed to declare the action of the second respondent in not changing the name of the village in respect of the fourth respondent Temple from Kavaparam to Korukonda, in spite of the reports of his subordinates as illegal and arbitrary. The case of the petitioner is that in spite of the letter dated 17.04.2011 addressed by the third respondent - Assistant Commissioner, Endowments Department, Rajahmundry, to the second respondent - Commissioner, Endowments Department, Hyderabad, recommending the change of name of the fourth respondent Temple from Kapavaram to Korukonda, the Commissioner did not take any action on the said recommendation.
When the matter is taken up for hearing, learned Government Pleader submits that, as per Section 45 of the A.P. Charitable and Hindu Religious Institutions and Endowments Act, 1987 (for short 'the Act'), any person aggrieved by an entry or omission to make an entry in the register maintained under Section 43 of the Act may make an application for modification or annulment of such entry, or for directing the making of such entry.
In view of the facts and circumstances of the case, liberty is given to the petitioner to file an appropriate application before the appropriate authority under Section 45 of the Act and, on such application being filed by the petitioner the same shall be considered and disposed of by the authority concerned in accordance with law as expeditiously as possible. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
