THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.15653 OF 2016 ORDER:
Petitioners, who are A1 and A2 in Cr.No.72 of 2016 of Yelamanchili Rural Police Station, Visakhapatnam District, registered for the offences punishable under Sections 20 (b) and 25 of NDPS Act filed this petition under Sections 437 and 439 Cr.P.C. seeking regular bail.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

perusal of the record reveals that on 08-08-2016 at about 7.00 A.M. on receipt of credible information that the petitioners were transporting 170 kgs of Ganja in Toyota Innova Car bearing No. AP 31 TF 2556, the officials intercepted the vehicle at Kokkirapalli and seized the Ganja. Thereafter, police registered a case for the above offences.

The contention of the learned counsel for the petitioners is that the petitioners have nothing to do with the alleged offence. As per the prosecution version, the officials seized nearly 170 kgs of Ganja from the accused. 5.
The learned Additional Public Prosecutor submitted that the investigation is in progress. 6.
If the petitioners are released on bail at this point of time, there is every chance of tampering with the evidence of the prosecution witnesses.

Having regard to the facts and circumstances of the case, I am of the considered view that it is not a fit case to grant bail to the petitioners.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending, in this petition shall stand closed.
