HONOURABLE SRI J USTICE N. BALAYOGI I.A.Nos. 5 AND 6 OF 2018 IN/AND MACMA.No. 296 OF 2011 COMMON ORDER:

These two interlocutory applications viz., I.A.Nos.5 and 6 of 2018 have been filed to receive additional evidence as prayed therein.

As the learned Counsel for the respondents did not oppose for the same, the said two Interlocutory applications are ordered as prayed for.

Learned Counsel for the appellant/driver of the crime vehicle submits that the entire compensation awarded by the Tribunal was paid to respondents 1 to 5 herein/claimants. The said submission of the learned Counsel for the appellant is admitted by the learned Counsel appearing for respondents 1 to 5/claimants. Further, learned Counsel on either submits that there is nothing to be adjudicated in the appeal and the same may be closed by recording that there is no liability cast upon the petitioner/appellant to pay compensation any more to respondents 1 to 4/claimants. Recording the said submission of the learned Counsel on either side, the appeal is closed as not pressed.
