THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26283 of 2017 ORDER:
The petitioner states that he is the owner of the lorry bearing No.AP 07 TF 9169. While so on 08.07.2017, the fourth respondent along with the revenue officials seized the said vehicle along with the stock and registered a case in Crime No.97/2017 under Section 420 read with Section 34 IPC and Section 7(1) of the Essential Commodities Act. The petitioner states that the fourth respondent has no jurisdiction to seize the stock without referring the same to the second respondent and seizure of the stock including the vehicle is arbitrary. Challenging the same, the present Writ Petition is filed. In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to submit an application for release of the vehicle before the second respondent, within a period of one week.
After receipt of the said application, the second respondent shall consider release of the vehicle, subject to the terms and conditions imposed by him, within a period of one week thereafter. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
