This writ petition is filed for a mandamus to declare the inaction of respondent Nos.2 and 3 in considering the petitioner's representations dt.20.12.2007, 27.09.2010, 27.11.2011 and 10.3.2015, for allotment of a shop at Tirumala, under rehabilitation scheme, as illegal and arbitrary.

On behalf of respondent No.2, a counter affidavit has been filed by its Executive Officer, wherein it is inter alia pleaded that as far back as 03.6.2013 the Assistant Executive Officer (Pan. & Rev.), passed an order in Roc. No.PO1(a)/23557/AEO/(P)/TML/1976, rejecting the request of the petitioner. A copy of the said order has been filed along with the counter affidavit. Mr. K. Mahadeva, learned counsel for the petitioner, submitted that his client has not received the said order. Even if the petitioner has not received the said order, the fact appears to remain that the order was passed as far back as 03.06.2013. Now that a copy of the said order is made available to the petitioner along with the counter affidavit, she is entitled to avail a fresh legal remedy, if she feels aggrieved by the said order. As an order was already passed on the petitioner's representations, the prayer in the writ petition has become infructuous.

The writ petition is accordingly dismissed with liberty to the petitioner to avail a fresh legal remedy as observed hereinbefore. As a sequel to dismissal of the writ petition, W.P.M.P.
