THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.16054 OF 2016 ORDER:

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue any Writ, order or direction more especially one in the nature of Writ of Mandamus declaring the action of the Respondents 2 to 5 in failing to register the complaint of the petitioner, Dt.30-04-2016 and not providing police protection to protect the possession of petitioners open land admeasuring 1000 Sq. Yards in Sy.No.136 at Kothapet Revenue Village, L.B Nagar Municipality, Ranga Reddy District as illegal, arbitrary and unconstitutional and consequently direct the Respondents 2 to 5 to provide police protection to the petitioners by registering the complaint, Dt.30-04-2016 pursuant to the interim injunction granted in I.A.No.322/2016 in O.S.No.243/2016, Dt.20-04-2016 on the file of Principal Junior Civil Judge Court, Ranga Reddy District at L.B Nagar, Hyderabad and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Though Sri Damodar Mundra, learned counsel, would state that he has filed an implead application on behalf of a third party, this Court is not inclined to entertain the writ petition for adjudication on merits as the learned Assistant Government Pleader for Home states that a crime has been registered basing on the complaint made by the petitioners.

Written instructions dated 11.05.2016 furnished by the Sub-Inspector of Police, Chaitanyapuri Police Station, Cyberabad, confirm the statement made by the learned Assistant Government Pleader as the Sub-Inspector stated therein that Crime No.253 of 2016 was registered

on the file of Chaitanyapuri Police Station under Sections 447 and 506 I.P.C. and investigation was taken up.

In that view of the matter, the cause in this writ petition does not survive for consideration on merits.

The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 12th May, 2016 IBL
