THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.18828 OF 2015 ORDER:

In this writ petition, the petitioner seeks a direction to the 4th respondent to complete the investigation in connection with Crime No.21 of 2015 dated 31.01.2015 and to file a charge sheet before the concerned Court.

According to the petitioner, after the death of her husband, since her four sons including the respondents 5 and 6, neglected to maintain her, she is residing at Arulananda Ashram at Chirala of Prakasam District. However, respondents 5 and 6 used to visit the said Ashram and threatened her to give them the FDRs lying in her favour. In that connection, she lodged a complaint with the 4th respondent, on the basis of which, a case in Crime No.21 of 2015 was registered against the respondents 5 and 6 for the offence under Sections 448, 509, 323 and 506 I.P.C. on 31.01.2015. However, so far, no action has been taken by the 4th respondent.

Having regard to the nature of grievance of the petitioner and since the petitioner is aged about 82 years, the respondents 3 and 4 are hereby directed to visit the said Ashram, where the petitioner is residing and take appropriate steps in pursuance of registration of Crime No.21 of 2015 in accordance with law and if necessary, summon the sons of the petitioner i.e. respondents 5 and 6 herein and give them necessary counselling.
