HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.11998 of 2015 ORDER :

The petitioner, who is accused in C.C. No.437 of 2014 on the file of the Court of the IV Special Magistrate, Hyderabad, for the offence punishable under Sections 353 and 323 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the petitioner is apprehending arrest, since the trial Court issued N.B.W. against the petitioner. Considering the same, the petitioner is directed to surrender before the Court concerned and to file an application to recall the warrant pending against the petitioner herein and on filing of such application, the trial Court is directed to recall the warrant on the same day on his executing a personal bond for Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner-accused is directed to report before the trial Court on all hearing days.

With the above observations, the Criminal Petition is disposed of.
