THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14520 of 2015 ORDER:

The relief sought for in this writ petition is to declare the action of the 2nd respondent in taking steps to sell the seized stocks of rice, paddy and broken rice total worth Rs.2,86,000/- belonging to the petitioner in public auction without issuing any show cause notice and without giving any opportunity to it to file its explanation as illegal and arbitrary.

Learned counsel for the petitioner contended that the petitioner is ready to furnish bank guarantee for the seized stocks worth Rs.2,86,000/-. The same has not been opposed by the learned Assistant Government Pleader for Civil Supplies. Therefore, there shall be stay of auction subject to the petitioner furnishing bank guarantee for Rs.2,86,000/- within a period of one (1) week from the date of receipt of a copy of this order failing which stay shall stand vacated and respondents are at liberty to conduct auction.

The writ petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
