THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CIVIL MISCELLANEOUS PETITION No.60 of 2017 ORDER:

This transfer petition is filed under Section 24 of CPC, seeking to withdraw D.O.P. No.161 of 2016 from the file of the Court of V Additional District Judge, Jangaon, Warangal District, and transfer the same to the file of the Court of Additional Family Court, Hyderabad to be tried along with O.P. No.1432 of 2013. 2.

Heard the learned counsel for the petitioner.

No representation on behalf of the respondent on 10.10.2018. Today also, there is no representation on behalf of the respondent even though the matter is listed under the caption, "For Orders". 3.

A perusal of the record reveals that the petitioner filed O.P. No.1432 of 2013 on the file of the Court of Additional Family Court, Hyderabad, against the respondent, under Section 10(1)(ix) & (x) of Indian Divorce Act, for dissolution of the marriage between the petitioner. The respondent filed D.O.P. No.161 of 2016 on the file of the Court of V Additional District Judge, Jangaon, Warangal District, against the petitioner, under Section 32 of Indian Divorce Act, for restitution of conjugal rights.

At the time of hearing, learned counsel for the petitioner submitted that O.P.No.1432 of 2013 was allowed on 21.3.2017 dissolving the marriage between the petitioner and the respondent. In view of the orders passed in O.P. No.1432 of 2013, no further orders are necessary in this petition.

Accordingly, the transfer civil miscellaneous petition is closed. Miscellaneous petitions, if any pending in this petition shall stand closed.
