THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.2775 OF 2017 ORDER:

This criminal petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed by the petitioner/A1 to enlarge him on bail in Crime No.57 of 2016 of Gadwal Town Police Station, Mahaboobnagar District, registered for the offences punishable under Section 498-A of I.P.C. and Sections 3 and 4 of Dowry Prohibition Act apprehending his arrest. Sri S.K.Rizwan Ali, learned counsel for the petitioner, while arguing the matter for some time, requested this Court to permit the petitioner to surrender before the Metropolitan Magistrate, Hyderabad and on such surrender if any application is filed under Sections 437 and 439 of Cr.P.C., the officer may be directed to decide the application on the same day.

In view of the request made by the learned counsel for the petitioner, without touching the merits of the case, I deem it appropriate to direct the petitioner to surrender before the Metropolitan Magistrate, Hyderabad, having jurisdiction, and on such surrender, if any application under Sections 437 and 439 of Cr.P.C. is filed, after serving notice on the Public Prosecutor, the Presiding Officer shall decide the said application on the same day, in accordance with law.
