Aggrieved by the action of the 1st respondent in not passing orders on the appeal preferred by the 7th respondent against order of the 2nd respondent in Proc.Rc.No.MC3, 2416/2014, dated 10.02.2107 in spite of several representations made by the petitioner, , this Writ Petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for respondents 1 & 3.

The grievance of the petitioner is that on petitioner's complaint, the Caste Certificate of the 7th respondent was cancelled by the 2nd respondent vide proceedings in Rc.No.MC3/2416/2014, dated 10.02.2017. Aggrieved by the same, 7th respondent preferred appeal before the 1st respondent on 07.03.2017 before the 1st respondent along with Stay Petition. In spite of caveat filed by the petitioner before the 1st respondent, the 1st respondent has stayed the orders of the 2nd respondent in Rc.No.MC3/2416/2014. Though the petitioner is ready, the appeal filed by the 7th respondent is not being disposed of by the 1st respondent. Aggrieved by the same, present Writ Petition is filed.

Learned counsel for the petitioner submits that even though arguments are heard by the 1st respondent, the appeal filed by the 7th respondent is not being disposed of, as a result of

which, the 7th respondent is enjoying the stay orders pending appeal before the 1st respondent.

In view of above facts and circumstances, without expressing any opinion on the merits of the case, since the appeal filed by the 7th respondent is stated to be pending before the 1st respondent, the 1st respondent is directed to dispose of the appeal, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
