CVNR, J & MSKJ, J W.P.No.3699 of 2017 THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY AND THE HON'BLE SRI JUSTICE M.S.K. JAISWAL WRIT PETITION No.3699 of 2017 ORDER: (Per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for the following substantive relief: "For the reasons stated in the affidavit filed in support of this writ petition, the petitioner humbly prays that this Hon'ble Court may be pleased to issue a writ, order or direction and more particularly one in the nature of writ of Certiorari by call for the records relating to the award, dated 26.09.2011 passed by the 2nd respondent vide LA.No.276 of 2011 in I.A.No.765 of 2008 in O.S.No.641 of 1996, and quash the same and declared as illegal, arbitrary against the rights guaranteed by the Constitution of India more particularly against to the fundamental rights guaranteed by the Constitution of India."
A perusal of the proceeding sheet shows that on 06.02.2017, the case was adjourned due to non-representation of the petitioner. Since then, the case was adjourned on four occasions at the request of the learned counsel for the petitioner. Even today, when the case is called, a further request for an adjournment was made on behalf of the learned counsel for the petitioner. In our opinion, the petitioner having filed the writ petition cannot be permitted to take adjournments at his will.
Hence, the writ petition is dismissed for non-prosecution. As a sequel to dismissal of writ petition, WPMP.No.4409 of 2016 filed by the petitioner stands dismissed as infructuous. ___________________________ C.V. NAGARJUNA REDDY, J __________________ M.S.K. JAISWAL, J 6th JULY, 2017.
