HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.23858 of 2018 ORDER:
Heard Mr.Anjaneyulu for petitioner and the learned Assistant Government Pleader for Revenue.
The petitioner complains alleged interference by 3rd respondent in an extent of Ac.2-30 cents in Sy.No.412/ 22 of Chamarru Village, Achampet Mandal, Guntur District, without recourse to law, as illegal, arbitrary and unconstitutional. The Assistant Government Pleader places on record written instructions dated 11.07.2018. The relevant portion of written instructions reads as follows :- " In this connection, the petitioner having only an extent of Ac.1.62 cents in Sy.No.412/ 22 of Chamarru Village as per our Revenue records and webland records, but the petitioner overwrite/ manipulate in his pattadar passbooks with an extent of Ac.2.30 cents instead of Ac.1.62 cents in Sy.No.412/ 22 of Chamarru Village and also we are not obstructing for carrying the agricultural activities by the petitioner against the land in Sy.No.412/ 22 measuring an extent of Ac.1.62 cents of Chamarru Village of Atchampet Mandal.
Hence, the allegations levelled by the petitioner against the Tahsildar, Atchampet that it has been obstructing from carrying the agricultural activities by the petitioner for the land in Sy.No.412/ 22 measuring an extent of Ac.2.30 cents of Chamarru Village of Atchampet Mandal are not true in nature and baseless."
Mr.Anjaneyulu submits that the 3rd respondent cannot unilaterally reduce the extent purchased by petitioner from Ac.2-30
cents to Ac.1-62 cents. According to him, there ought not to be correction or interference with the details in 1-B Register and the Adangal.
On the other hand, the learned Assistant Government Pleader contends that it is matter of verification of entitlement of each one of the owners in Sy.No.412/ 22.
Before accepting the extent held by petitioner, if the extent held and possessed by vendor of petitioner is appreciated, as recorded in the revenue records, the entries can be confirmed or continued to be maintained. The exercise is in the nature of verification of record.
Therefore, the petitioner is given liberty to represent to 3rd respondent with all antecedent documents and ask for appropriate relief as warranted in the circumstances of the case. On such representation being made, the 3rd respondent considers, hears all owners in Sy.No.412/ 22 and passes orders within eight weeks thereafter.
The writ petition is disposed of accordingly. No order as to costs.
