This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.316 of 2025 of Karimnagar Rural Police Station, Karimnagar District.

The brief facts of the case are that the alleged incident occurred between 18.08.2025 at 10:00 PM and 19.08.2025 at 5:30 AM at Krishna Nagar, Bommakal, and was reported on 19.08.2025 at 8:30 AM by the complainant, stating that her mother, had suffered an electric shock, resulting in the loss of her right leg, left hand, and the fingers of her right hand. Five years earlier, the father of the complainant, borrowed Rs.4,00,000/- from the petitioner. Though he repaid about Rs.15,00,000/- with interest in installments, he recently received a legal notice demanding an additional Rs.27,60,000/-. The petitioner along with accused No.2 pressurized him to register land measuring 6 guntas in
Sy.No.144/D and attempted to grab the property. Due to the harassment and mental distress, Srinivas left home at 10:00 PM on 18.08.2025. On 19.08.2025 at 5:30 AM, he was found hanging with a plastic rope from a mango tree behind his house and was declared dead.

Heard Sri Pulimamidi Shashidhar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri E. Ganesh, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that there was no abetment in this case and that the petitioner is innocent of the alleged offence. He advanced the amount for his family necessities and thereafter issued a legal notice for its repayment. The deceased had already issued a cheque which was dishonoured, and for that, the petitioner sent a legal notice to the deceased. Except for lending money to the deceased, there was no act of abetment by the petitioner. Therefore, Section 108 of the BNS is not attracted, and he prayed the Court to grant pre-arrest bail to the petitioner by allowing the criminal petition.

On the other hand, learned Assistant Public Prosecutor opposed the bail stating that there are specific allegations against the petitioner and due to the harassment only, the deceased committed suicide. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, the allegation against the petitioner is that he had lent money to the deceased and, even after repayment, demanded a huge additional amount. There are no specific allegations in the complaint to show that the petitioner had contacted the deceased on the date of the incident. As seen from the record, the material part of the investigation has been completed. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Karimnagar Rural Police Station, Karimnagar District, within two weeks from today, and on such surrender, the said
Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
