HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P. No. 157 of 2016 ORDER:

This petition is filed to withdraw O.P.No.22 of 2016 from the file of Senior Civil Judge, Jagtial, Karimnagar District, and transfer the same to Family Court, City Civil Court, Hyderabad.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 02.05.2014 at Sri Venkateshwara Kalyana Mandapam, Jeedimetla, Hydeabad and after marriage she joined respondent at Prakruthi House, Suchithra Enclave, Hyderabad and thereafter respondent left for Dubai in June, 2014 leaving her at her parents house. She stated that after some time she also joined respondent at Dubai and there she was mentally and physically tortured and as she has no supporting persons at Dubai. She stated that respondent informed her that he booked air ticket for her to go back to Hyderabad and that he would also join her, but she was sent alone and she came back to Hyderabad and now living with her parents. She further stated when she tried to contact respondent over phone, he refused to speak to her and thereafter she approached Women Police Station and lodged a complaint before Assistant Commissioner of Police, Hyderabad, on 25.01.2016.

She stated that respondent filed O.P.No.22 of 2016 before Senior Civil

Judge, Jagtial, Karimnagar District, and she is now residing at Hyderabad and it is difficult for her to attend Jagtial Court from Hyderabad as she has no male member to accompany her. She stated that she has no source of income or employment to meet the travel expenses to attend the Court at Jagtial. She also stated that she apprehend danger to her life in the hands of respondent if she go to Jagtial alone, for these reasons, she prayed for transfer of O.P.No.22 of 2016 from Senior Civil Judge, Jagtial, Karimnagar District, to Family Court, Hyderabad.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

5. Considering the reasons stated in the affidavit and also taking convenience of wife into consideration, O.P.No.22 of 2016 is withdrawn from Senior Civil Judge, Jagtial, Karimnagar District, and transferred to Family Court, City Civil Court, Hyderabad, for disposal in accordance with law.

6. Accordingly, this transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
