O R D E R
The case of the petitioner is that he purchased the subject land in an extent of Acs.2.24 gts. in Sy.No.564/A, and an extent of Acs.2.36 gts. in Sy.No.635AA/1, situated at Samudrala village, Koheda mandal, Husnabad Division, Siddipet District, under registered sale deed bearing document No.693 of 1988, dated 24.05.1988. When he intended to sell the subject land for his personal necessities and approached the Sub Registrar, Husnabad, he informed that the land in Sy.Nos.564 and 635 is shown as government land and is included in the list of prohibited properties under Section 22-A of the Registration Act, 1908.
As such, he made a representation to the 4th respondent - Tahsildar, Koheda Mandal, Husnabad, Siddipet District, and in pursuance of the said representation, and also letters addressed by the 3rd respondent - Revenue Divisional Officer, the 4th respondent submitted a detailed report to the 3rd respondent, vide Lr.No.C/1167/2019 dated 14.10.2019, stating that the subject land is not assigned to anybody and it is recorded as patta land in the revenue records and therefore, recommended for issuance of No Objection Certificate (NOC) to the petitioner. As the 3rd respondent has not issued NOC till dated, enabling the petitioner to alienate the subject land, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.
Having regard to the facts and circumstances of the case and the submissions of the leaned counsel, writ petition is disposed of directing the 3rd respondent to take further action in accordance with law in pursuance of the communication of the 4th respondent vide Lr.No.C/1167/2019 dated 14.10.2019, within a period of eight weeks from the date of receipt of a copy of this order.
Interlocutory applications pending, if any, shall stand closed. No order as to costs.
