Heard Sri A.Jagan, learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel for the

respondents-APSRTC.

2. The petitioner was working as a conductor in the Andhra Pradesh State Road Transport Corporation having been appointed on 27-4-2006 and was attached to the 3rd respondent-Depot. While so, by proceedings dated 21-8-2006, the services of the petitioner were terminated without conducting any domestic enquiry. The learned counsel appearing for the petitioner would submit that the termination of the petitioner without following the principles of natural justice and without conducting a domestic enquiry is illegal and the impugned order is liable to be set aside.

3. According to the petitioner, he fell sick and was under the continuous observation of doctors in various hospitals and therefore, he could not attend the duty for some time. Earlier, he filed W.P.No.15602 of 2014 and this Court directed him to prefer an appeal. Accordingly, he preferred an appeal before the Appellate Authority. Thereafter, the appeal was rejected. Aggrieved thereby, he filed the present writ petition.

On identical facts, learned single Judge of this Court in W.P.No.819 of 2015 directed the respondents to consider the case of the petitioner therein for appointment as a conductor on contract basis duly taking into account his eligibility and suitability for such engagement and to pass appropriate orders.

5. This writ petition is, therefore, disposed of directing the respondents to consider the case of the petitioner for appointing him as a conductor subject to his eligibility to the said post within a period of 30 days from the date of receipt of a copy of this order. It is made clear that the petitioner is not entitled for any benefits. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
