- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WP.No.26771 of 2016 ORDER :

In LTR Case No.73/2015/PVC, the Special Deputy Collector (Tribal Welfare) passed orders directing ejectment of respondent therein and to restore the subject property to the Scheduled Tribe petitioner therein. The petitioner claiming to be in possession of the said land, aggrieved by the order of Special Deputy Collector, preferred appeal in SR.No.326/15-6-16 along with condone delay application and also application to grant stay. Alleging that stay application is not considered, this writ petition is filed.

02. This Court by order dated 11-08-2016 granted interim stay as prayed for, pending disposal of the appeal, dated 29-07-2016. Praying to vacate the said interim order, WVMP.No.4066 of 2017 (IA No.1/2017) is filed. When the matter is taken-up, learned counsel for the petitioner as well as learned counsel appearing for the respondents request to dispose of the writ petition with a direction to the appellate authority to pass orders on the applications/appeal pending before him as expeditiously as possible.

In regard to these submissions, the writ petition is disposed of directing the Project Officer, ITDA,Bhadrachalam to consider the appeal vide SR.No. 326/15-6-16 along with I.A. and to pass appropriate orders in accordance with law, as expeditiously as possible not later than two months from the date of receipt of a copy of this order, after affording opportunity of hearing to both parties. Till the orders are passed by the appellate authority as

- 3 - directed above, status-quo obtaining as on today shall be maintained. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
