HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10036 OF 2017 ORDER:

The case of the petitioner is that she was granted DKT patta vide proceedings dated 22.05.2016 and was also granted pattadar pass books and title deeds in respect of the land to an extent of Ac.1.54 cents in Survey No.822/P1 of Settivaripalli, Mudukuru Mandal, YSR Kadapa District. The petitioner made application to the 2nd and 3rd respondents for demarcation of the aforesaid land by paying necessary fee through AP online on 10.06.2016. Basing on the said application, the 3rd respondent issued a notices dated 14.12.2016 to the adjacent owners by fixing the demarcation date. But, till today, the respondents have not demarcated the land nor conducted survey. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader on instructions submits that that the 4th respondent is objecting for survey of the lands.

Since it is stated that notices have already been issued for demarcation, it is for the Mandal Surveyor to conduct survey by taking aid of the police if necessary.

In view of the same, the Mandal Surveyor is directed to conduct survey after taking into consideration the objections raised by the third parties.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
