This Writ Petition is filed challenging the order of refusal, dated 31-10-2009, passed by respondent No.3.

This Court passed an interim order on 02-12-2009 directing respondent No.1 to register the document presented by the petitioner on 05-03-2009 for registration, if Survey No.24/AA does not fall in the description of the Government Land and to release the document forthwith.

The learned Counsel for the petitioner submits that neither the document was registered nor it was released. During the course of hearing, it has come to light that in the document only Survey No.24 was mentioned without any subdivision number. Since the land covered by Survey No.24 is a prohibited land, it was rightly refused for registration by respondent No.3.

Accordingly, this Writ Petition is disposed of giving liberty to the petitioner to take appropriate proceedings in accordance

ARLR, J WP.No.25595 of 2009 Dt: 27.07.2017 with law. It is needless to observe that as and when the petitioner produces No Objection Certificate from the District Collector concerned, the Sub-Registrar concerned shall consider the document afresh and take appropriate steps for registration, if it is otherwise in order.
