According to the petitioners, their family has ancestral land to an extent of Ac.7-08 guntas in Sy.Nos.454/30/1, 454/23/71 and 454/105, situated at Nagulapally Revenue Village, Dammapet Mandal, Bhadradri Kothagudem District. They were issued Pattadar Pass Book and Title Deeds bearing Patta No.102 in respect of the said land. Petitioner No.1 claims that he is cultivating Ac.2-00 of land in Sy.No.454/23/71 along with his son. Petitioner No.1 claims that he made a representation dt.22.10.2019 for issuance of a new Pass Book as per the revised exercise undertaken by the Government. But, so far, new Pass Book is not issued reflecting the above extent of land. In addition to the above representation dt.22.10.2019, petitioner No.1 also filed another representation dt.03.10.2019, the contents of which disclose that his father gave Ac.1-00 of land to his sister's husband by way of gift. Whereas, the respondents are trying to allot this extent of land to the burial ground and they are not agreeable for parting with the said land for burial ground. 2.

As seen from the contents of representation dt.03.10.2019, in other words, petitioner No.1 is asking for mutation of the names of the children of his sister. That would be entirely a different issue and apparently, so far no application is made for mutation of the names of children of his sister in respect of the subject land. Further, it is to be seen that the petitioner made a representation dt.22.10.2019 to respondent No.3 - Revenue Divisional Officer, whereas the competent authority to issue Pattadar Pass Book is the Tahsildar.

Therefore, without going into the merits of the case, this writ petition is disposed of granting liberty to the petitioners to submit a copy of representation made to Revenue Divisional Officer to respondent No.4 - Tahsildar, enclosing a copy of this order and on receipt of such representation along with a copy of this order, respondent No.4 - Tahsildar shall take appropriate steps for issuance of Pattadar Pass Book in respect of the subject land to the petitioners in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. No order as to costs. 5.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
