HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.15803 of 2017 Order:

This Writ Petition is filed challenging the inaction of the second respondent in taking action against the third respondent who is interfering in civil dispute.

The petitioner states that on 13.12.2016 the police of Arundalpet Police Station came to her house and took her and her sister in an Auto and produced before the CI of Police. He directed the Sub-Inspector of Police, third respondent to investigate into the matter, as a complaint was lodged against them. The complainant earlier took an amount of Rs.3,00,000/- from the petitioner and when the petitioner demanded repayment of the amount she appears to have lodged a complaint. However, when the third respondent was repeatedly calling the petitioner to the police station, the petitioner submitted a representation to the second respondent. When the second respondent did not take action, the present Writ Petition is filed seeking a direction to the second respondent to take action in accordance with G.O.Ms.No.288, Home (PS&C.A2) Department, dated 06.11.2010.

In view of the nature of allegation of the petitioner, the petitioner is given liberty to approach the Superintendent of Police, Guntur to submit a written representation against the highhanded action of the third respondent and on receipt of such representation the Superintendent of Police, Guntur shall take necessary action in accordance with law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
