THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON No.9444 of 2017 ORDER: (Per Justice Sanjay Kumar) This writ petition was filed by the applicant in O.A.No.231 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, seeking implementation of the order dated 01.04.2016 passed therein. By the said order, the Tribunal took note of the fact that the petitioner had retired from service on 30.09.2015 while working as a Panchayat Secretary Grade-II and directed the authorities to pay provisional pension to him within two months from the date of receipt of a copy of the order pending disposal of the criminal case registered against him.

Notice having been ordered, learned Assistant Government Pleader appearing for the State fairly conceded that no writ petition was filed challenging the aforestated order passed by the Tribunal. That being so, in terms of the undertaking given by the learned Advocate General for the State of Telangana, which was recorded by the Division Bench of this Court comprising the Hon'ble The Acting Chief Justice and the Hon'ble Sri Justice U. Durga Prasad Rao in its order dated 30.09.2016 in W.P.No.31905 of 2016, the respondents are bound to implement the aforestated order passed by the Tribunal. We accordingly dispose of the writ petition directing the respondents to abide by and implement the order dated 01.04.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.231 of 2016.

This exercise shall be completed expeditiously and, in any event, not later than three weeks from the date of receipt of a copy of this order.
