THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.10970 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS') by the petitioner/accused seeking anticipatory bail in connection with FIR No.420 of 2025 of Chilkalguda Police Station, Hyderabad. The offences alleged against the petitioner are under Sections 318 (4) and 338 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS'). 2.

The facts of the case are that the defacto complainant lodged a complaint before police stating that he is the attorney holder of his brother-in-law A.Rajeshwar Rao, who is an Australian Citizen and he is giving complaint on his behalf. It is stated that A.Rajeshwar Rao, the Director of Lorven Petroleum Services Pvt. Ltd., HR and L.Priyanka- petitioner herein have started business at Hyderabad under the registered companies Act in the name and style of M/s.Lorven Petroleum Services Pvt. Ltd., in the year 2020. It is further alleged that without the knowledge of his brother-inlaw, the petitioner used Rs.73,58,000/- from the company account for her personal use, due to which, his brother-in-law received summons to the Indian address. As such, complaint was lodged

- 2 - on behalf of A.Rajeshwar Rao against the accused for the above offences. Basing on the said complaint police registered the case against the accused for the above offences.

Heard Sri K.Rajashekar, learned counsel for the petitioner and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said offences and there is delay in lodging the report. The alleged incident occurred in the year 2021 and complaint was lodged in 2025; that all evidence in this case is documentary in nature, as such, custodial interrogation of the petitioner is not necessary, further the police have issued Section 94 of BNS notice and petitioner is submitting the documents whatever required, as such requested this Court to grant anticipatory bail to the petitioner.

On the other hand learned Additional Public Prosecutor opposed bail stating that the amount involved in this case is huge and there are serious allegations against the petitioner which requires custodial interrogation. As such, prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material on record, there is delay in lodging report before police and the allegations are based on the documentary evidence. The petitioner is already served with notice under Section 94 of BNS for producing necessary documents. Considering the circumstances of the case, this Court deems it appropriate to grant bail to the petitioner/accused subject to the following conditions: i.

The petitioner/accused shall surrender before the Station House Officer, Chilkalguda Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on her executing a personal bond for Rs.25,000/- (Rupees Twenty five thousand only) each with two sureties, for the like sum each. ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.
