HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5496 OF 2017 ORDER:

The case of the petitioner is that he is the absolute owner and possessor of the land in Survey No.43/3, 43/4, 43/5, and 43/6, total admeasuring Ac.3.19 guntas, situated at Naspur Village & Mandal, Mancherial District and that he submitted application for conducting survey before the 3rd respondent and in turn the 3rd respondent directed the 4th respondent to conduct survey and demarcate Survey No.43 of Naspur Village. In pursuance of the same, the 4th respondent issued notice dated 28.10.2016, fixing survey date as 05.11.2016.

But, on 05.11.2016, though survey was conducted, boundary was not fixed due to objection petition filed by one Hanumantha Raju. Thereafter, the 4th respondent considered the objections of Hanumantha Raju, and through Memo dated 19.12.2016 advised him to approach the revenue authorities. But, subsequently, the survey in respect of petitioner's land was not conducted till today. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Revenue on instructions submits that one Hanumantha Raju filed objections with regard to survey and as such, survey could not be conducted. A perusal of the Memo dated 19.12.2016 filed by the petitioner along with this writ petition goes to show that the

objections of the Hanumantha Raju were considered and disposed of advising him to approach revenue authorities. In view of the same, the respondent authorities are directed to take further action in the matter of conducting survey of the petitioner's lands. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.03.2017 tk
