This Civil Miscellaneous Appeal is preferred by the claimants against the judgment and decree dated 26.02.2003 passed in O.P.No.141 of 1995 by the learned First Additional District and Sessions Judge, Medak, at Sangareddy. The appellants/claimants preferred the aforesaid OP claiming compensation of Rs.1,20,000.- on account of death of one Errolla Mogulaiah in the alleged motor

vehicle accident that occurred on 17.7.1994. It came on record that the appellants/claimants filed W.C.No.34 of 1995 before the Assistant Commissioner of Labour, Sangareddy. The said WC was pending at the time of consideration of OP.No.141 of 1995. The Tribunal dismissed the OP on the ground that WC No. 34 of 1995 was pending at the time of consideration of the OP and that the accident did not occur when the vehicle was in moving condition, but it was in the idle condition. Today when the case is called, none appeared for the appellant. In view of the above, the Civil Miscellaneous Appeal is dismissed. Miscellaneous petitions pending consideration if any in the appeal shall stand closed in consequence. No order as to costs.
