THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY WRIT PETITION No.18881 OF 2015 ORDER:

This writ petition is filed seeking direction against the respondents to pay Rs.2,15,483/- which the petitioner allegedly incurred for maintaining the Kasturba Gandhi Balika Vidyalaya Balika Vidyalaya (KGBV) hostels at Burivanka and Kaviti Villages, Srikakulam District.

The petitioner was appointed as Special Officer, KGBV, Burivanka, Kaviti Village, on 22.03.2013 under Sarva Shiksha Abhiyan and later entrusted additional charge of KGBV, Kaviti of Ichapuram, and his duties are to act as a Manager to manage the said hostels. However during the period of his engagement, as the Government did not provide funds, the petitioner allegedly incurred Rs.1,37,000/- to maintain the hostel at Ichapuram Village and Rs.75,577/- to maintain the hostel at Burivanka of Kaviti Village. Despite, repeated demands, the said amount was not paid to the petitioner by the respondents. Therefore, sought for aforesaid direction.

The respondents filed counter admitting the appointment of the petitioner as Special Officer, to manage KGBV Burivanka and placing him as giving additional charge of hostel of Kaviti of Ichapuram of KGBV and their liability to pay Rs.1,37,000/-, but denied the liability to pay Rs.75,577/- allegedly incurred by the petitioner at KGBV hostel, Kaviti, as mentioned in penultimate paragraph at page 5 of their counter. The respondents also denied the liability, requested to issue a direction to the petitioner to approach the respondents with documentary evidence in support of his claim for Rs.75,577/- so as to enable them to pay the amount.

04. During hearing, learned counsel for the respondents drawn attention of this Court to the penultimate paragraph at page 5 of the

counter, where the respondents clearly admitted about the liability to pay Rs.1,37,000/- to the petitioner, and to consider the claim of the petitioner for Rs.1,37,000/-, the petitioner shall approach the 4th respondent with documentary evidence in support of his claim.

05. Recording the concession of the counsel for the respondents, I find it is just and necessary to issue a direction to the respondents to pay Rs.1,37,000/- within 8 weeks from today.

06. Accordingly, the petitioner is directed to approach the respondents with documentary proof in support of his claim for Rs.75,577/- within one month from today and on such production, the respondents are directed to settle the claim within one month thereafter.

07. With the above direction, the writ petition is disposed of. No costs.

08.Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
