HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.7987 OF 2019 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.679 of 2016 on the file of the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. A charge sheet came to be filed against the petitioners/A-2 and A-3 for the offences punishable under Section 498-A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act, 1961.
Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners/A-2 and A-3 restricts his prayer seeking dispensation of the presence of the petitioners/A-2 and A-3 before the trial Court on every date of adjournment. The learned Public Prosecutor submits that since the identity of petitioners/A-2 and A-3 is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.
Having regard to the facts and circumstances of the case, the personal appearance of the petitioners/A-2 and A-3 in C.C.No.679 of 2016 on the file of the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, is hereby dispensed with except on the dates when their presence is specifically required by the Court.
With the above direction, the Criminal Petition is disposed of.
Miscellaneous applications, if any, pending shall stand closed.
